Hawaii Legislature Introduces Eleven (11) Marijuana Legalization Bills

The Hawaii Legislature introduced eleven (11) bills to legalize recreational marijuana. House Bill 686 establishes a regulatory framework for the licensing and oversight of recreational marijuana establishments. The bill is less prescriptive than other states, which might make Hawaii an attractive recreational market for entrepreneurs.

Summaries of the eleven (11) bills are provided below including links to the legislative text.

  • HB 686 Relating to Marijuana

    • Allows personal cultivation of six (6) marijuana plants with three or fewer being mature.

    • The Department of Taxation must adopt regulations implementing the licensing and oversight of commercial marijuana establishments by July 1, 2020 including cultivation, processing, testing facilities and retail stores.

    • Application fees are capped at $5,000 unless the business operations justify a higher fee.

    • Marijuana establishments must pay sales and excise taxes.

    • The bill does not indicate whether the Department of Taxation can limit licenses, or if local authorities can opt out.

  • HB 442 Relating to Marijuana

    • The legislature finds that the cost of enforcement is substantial at $9,300 per marijuana conviction.

    • The bill legalizes marijuana possession, cultivation, use or transport. However, unlike other states, this bill does not provide a limit.

    • A county may adopt regulations that provide for the operating of a marijuana establishment including the cultivation, possession, sales, transfer and use of marijuana.

    • Lacks a statewide licensing and oversight framework.

  • HB 434 Relating to Marijuana

    • A hearing was held on January 29, 2019.

    • Establishes the Alcohol and Drug Abuse Special Fund.

    • Reclassifies low level marijuana possession as non-criminal violations

  • SB 606 Relating to Marijuana

    • Reclassifies marijuana except for providing to a minor.

    • Provides ability to expunge cannabis conviction so long as it is the only charge.
