Florida: Palmetto Bay Zoning Commission: Adoption of Ordinance Allowing Medical Marijuana Treatment Facilities

VILLAGE OF PALMETTO BAY 
NOTICE OF ZONING PUBLIC HEARING 

The Village of Palmetto Bay shall conduct a Zoning Public Hearing requiring Public Hearings on Monday, June 17, 2019, at 7:00 p.m. at Village Hall, 9705 East Hibiscus Street, Palmetto Bay, FL. Discussion and public input will be welcomed concerning the following item that may be of interest to your immediate neighborhood. 

Pursuant to section 30-30.3(d)(2) of the Village's Code of Ordinances, the Village of Palmetto Bay proposes to adopt the following Ordinance on Second Reading requiring a public hearing on the administrative development approval: 

; AN ORDINANCE OF THE MAYOR AND VILLAGE COUNCIL OF THE VILLAGE OF PALMETTO BAY, FLORIDA, RELATING TO ADMINISTRATIVE RESIDENTIAL DEVELOPMENT APPROVALS; AMENDING THE CODE OF ORDINANCES, SECTION 30-30.3(D)(2) ADMINISTRATIVE APPROVAL; PROVIDING FOR AN INCREASE IN THE ALLOWABLE ADMINISTRATIVE VARIANCE PERCENTAGE APPROVAL TO THE LESSER OF TWENTY-FIVE (25%) OR FIVE FEET FOR NON-USE VARIANCE APPLICATIONS FOR DEVELOPMENT FOR LOT COVERAGE, SETBACK, HEIGHT, BUFFER, LOT DIMENSION AND/OR FLOOR AREA RATIO (FAR) REQUIREMENTS, UNLESS A PUBLIC HEARING IS REQUIRED; PROVIDING FOR SEVERABILITY AND AN EFFECTIVE DATE. The following Ordinances shall be heard on Second Reading. A public hearing shall be held on the following matters:

; AN ORDIANCE OF THE MAYOR AND VILLAGE COUNCIL OF THE VILLAGE OF PALMETTO BAY, FLORIDA, RELATING TO MEDICAL MARIJUANA DISPENSARIES; CREATING SECTION 30-60.32; ADDRESSING MEDICAL CANNABIS DISPENSARIES, MEDICAL MARIJUANA TREATMENTFACILITIES, AND INDEPENDENT TESTING LABORATORIES WITHIN THE MUNICIPAL BOUNDARIES OF THE VILLAGE OF PALMETTO BAY; ALLOWING AND REGULATING MEDICAL MARIJUANA DISPENSARIES ONLY ON THE BUSINESS DISTRICT LIMITED (B-1) ZONE ALONG US1 AND NO LESS THAN 1,000 FEET FROM A SCHOOL, PLACE OF WORSHIP OR PARK, AND NO LESS THAN 1 MILE FROM ANOTHER DISPENSING FACILITY; AND PROVIDING FOR AN EFFECTIVE DATE.
