California: City of Fairfax: Consider Ordinance to Permit Certain Medical Marijuana Dispensaries to Conduct Adult-Use Cannabis Deliveries

TOWN OF FAIRFAX NOTICE OF PUBLIC HEARING BEFORE THE FAIRFAX PLANNING COMMISSION TO CONSIDER AN ORDINANCE TO PERMIT CERTAIN MEDICAL MARIJUANA DISPENSARIES TO CONDUCT ADULT-USE CANNABIS DELIVERIES. ANY AND ALL INTERESTED PERSONS MAY APPEAR AND BE HEARD. Notice is hereby given that on Thursday, October 18, 2018 at 7:00 p.m., or as soon thereafter as the matter may be heard, the Fairfax Planning Commission will hold a public hearing on the matter described below at the Fairfax Women's Club, 46 Park Road, Fairfax, California. Description: The Planning Commission will consider a resolution recommending that the Town Council adopt zoning ordinance text amendments to add provisions for certain existing medical marijuana dispensaries to conduct delivery of adult-use (recreational) cannabis. No adult-use cannabis retail sales shall be permitted to occur at the premises of a medical marijuana dispensary. All cannabis deliveries must conform to State laws and regulations adopted pursuant to the Medicinal and Adult-Use Cannabis Regulation and Safety Act. The staff report and associated materials will be available for public review on the Town Hall front counter, the Fairfax Library, and online at at least 72 hours before the hearing. Location: Town-wide. Environmental Review: The proposed action is exempt from CEQA pursuant to Sections 15061(b)(3), 15301, 15305 and 15183 of the CEQA Guidelines as separate and independent bases. Anticipated Actions: The Planning Commission will hear a staff report, take public testimony, discuss the proposed ordinance, and vote on a resolution recommending adoption of the ordinance to the Fairfax Town Council.
