Section 1: That Chapter 405, of the City Code of the City of Dexter, Missouri is hereby amended by adding the following definitions to read as follows: (NOTE TO CODIFIER: PLEASE PUT THESE DEFINITIONS IN ALPHABETICAL ORDER ALONG WITH THE EXISTING DEFINITIONS WHICH HAVE NOT CHANGED).

“Section 405.010. Definitions.

Church. A building set apart for regularly scheduled public religious worship, not including units in a strip mall or other semi-detached buildings in a commercial area.

Marijuana or marihuana. Marijuana or marihuana means Cannabis indicia, Cannabis sativa, and Cannabis ruderalis, hybrids of such species, and any other strains commonly understood within the scientific community to constitute marijuana, as well as resin extracted from the plant and marijuana-infused products. Marijuana or marihuana does not include industrial hemp containing a crop wide average tetrahydrocannabinol concentration or products manufactured from industrial hemp.

Marijuana-infused products. Marijuana-infused products means products that are infused with marijuana or an extract thereof and are intended for use of consumption other than by smoking, including, but not limited to, edible products, ointments, tinctures, and concentrates.

Medical marijuana cultivation facility. Medical marijuana cultivation facility means a facility licensed by the State of Missouri to acquire, cultivate, process, store, transport, and sell marijuana to a medical marijuana dispensary facility, to a medical marijuana testing facility, or to a medical marijuana-infused products manufacturing facility.

Medical marijuana dispensary facility. Medical marijuana dispensary facility means a facility licensed by the State of Missouri to acquire, store, sell, transport, and deliver marijuana, marijuana-infused products, and drug paraphernalia used to administer marijuana as provided for in this chapter to a qualifying patient, a primary caregiver, another medical marijuana dispensary facility, a medical marijuana testing facility, or a medical marijuana-infused products manufacturing facility.

Medical marijuana-infused products manufacturing facility. Medical marijuana-infused products manufacturing facility means a facility licensed by the State of Missouri to acquire, store, manufacture, transport, and sell marijuana-infused products to a medical marijuana dispensary facility, to a medical marijuana testing facility, or to another medical marijuana-infused products manufacturing facility.

Medical marijuana testing facility. Medical marijuana testing facility means a facility certified by the State of Missouri to acquire, test, certify, and transport marijuana.

Primary caregiver.
Primary caregiver means an individual twenty-one years of age or older who has significant responsibility for managing the well-being of a qualifying patient and who is designated as such on the primary caregiver's application for an identification card under Article XIV, Section 1, Right to access medical marijuana, of the Missouri Constitution or in other written notification from the State of Missouri.

Qualifying patient. Qualifying patient means “a Missouri resident who has been issued a qualifying patient identification card by the State of Missouri Department of Health and Senior Services.”

Section 2. That Chapter 405, Section 070(B) of the City Code of the City of Dexter, Missouri, is hereby amended to add the following:
“Section 405.070(B). A-1 Agricultural District Regulations.

• 10. Nurseries and greenhouses, for growing or propagation of plants, turf, trees, and shrubs, including medical marijuana cultivation facility.”

Section 3. That Chapter 405, Section 100(B) of the City Code of the City of Dexter, Missouri, is hereby amended to add the following:
“Section 405.100(B). C-1 General Business District.

• 38.Drugstores and medical prescriptions centers, including medical marijuana dispensary facility.”

Section 4. That Chapter 405, Section 110(B) of the City Code of the City of Dexter, Missouri, is hereby amended to add the following:
“Section 405.110(B). C-2 Highway Commercial District.

11. Drugstores and medical prescriptions centers, including medical marijuana dispensary facility.”

Section 5. That Chapter 405, Section 120(B) of the City Code of the City of Dexter, Missouri, is hereby amended to add the following:
“Section 405.120(B). I-1 Industrial District.

• 28. The manufacturing, compounding, processing, packaging, or storage of such goods, materials, and products as the following:

• i.Food products, including beverage blending or bottling, bakery products, candy manufacture, ice and dairy products, fruit and vegetable processing and canning, packing, and processing of meat and poultry products, but not distilling of beverages or slaughtering of poultry or animals.

• ii.Articles made from previously prepared materials, such as bone, canvas, cellophane, cloth, cork, feathers, felt, fiber, fur, glass, hair, horn, leather, paper, plastics, precious or semiprecious metals or stone, shells, textiles, wax, wire, yarns, and the like.

• iii. Musical instruments, toys, novelties, rubber or metal stamps, and other small, molded products.

• iv.Medical marijuana cultivation facility, medical marijuana-infused products manufacturing facility, or medical marijuana testing facility.”

Section 6. That Chapter 405, Section 125 of the City Code of the City of Dexter, Missouri, is hereby amended to added to read as follows:
“Section 405.125. Medical Marijuana.
A medical marijuana cultivation facility, a medical marijuana dispensary facility, a medical marijuana-infused products manufacturing facility, or a medical marijuana testing facility may not be located within five hundred (500) feet of a previously existing state-licensed daycare, church, or public or private school measured the shortest straight line distance from building to building.”
Section 7. It is the intent of the Mayor and Board of Aldermen and it is hereby ordained that this Ordinance shall become and be made a part of the City Code of the City of Dexter, Missouri, and that sections of this Ordinance may be renumbered to accomplish such intention.
Section 8. If any section, subjection, sentence, clause, phrase or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof.

The Wheaton City Council, acting as a committee/ hearing body, will hold a public hearing on Monday, August 26, 2019 at 7:00 p.m. in the Council Chambers of the Wheaton City Hall, 303 West Wesley Street, Wheaton, Illinois, to consider the following zoning application:

Zoning Application #19-13. An amendment to the text of the Wheaton Zoning Ordinance, Article 3 - Zoning Districts and General Regulations and Article 21 - M-1 Manufacturing District.

The proposed text amendment will consider adding the following language to Article 3: “3.5 Cannabis Business Enterprises Prohibited: That cannabis business enterprises as defined in the Cannabis Regulation and Tax Act (House Bill 1438)(hereinafter “Cannabis Act”), as of the date of the adoption of this Ordinance, which currently includes cultivation centers, craft growers, processing organizations, dispensing organizations, and transporting organizations, and any future amendments to the definition of cannabis business establishments under the Cannabis Act, are hereby prohibited uses in any and all zoning districts within the corporate boundaries of the City of Wheaton.”

The proposed text amendment will further consider deleting Article 21.1.9 in its entirety and replacing it with the following language: “

9. Cultivation Centers and Dispensing Organizations, as defined by the State of Illinois Compassionate Use of Medical Cannabis Pilot Program Act, subject to the condition that those Cultivation Centers and Dispensing Organizations shall be prohibited from also conducting business as a Cannabis Business Enterprise as defined in the Cannabis Regulation and Tax Act (House Bill 1438).”

6. Amend Section 155.417(G)(1)(a) of the Village Code to add “Cannabis Dispensing Facility operated in strict compliance with State law applicable thereto” to the list of permitted uses in the B4A Roosevelt Road Corridor District;

7. Amend Section 155.418(C) of the Village Code to add “Cannabis Dispensing Facility operated in strict compliance with State law applicable thereto” to the list of conditional uses in the B5 Central Business District; also amend Section 155.418 (B) to read “Permitted Uses: Excluding cannabis dispensing facilities, any use permitted in the B3 District shall be permitted in the B5 District;

8. Amend Section 155.419(C) of the Village Code to add “Cannabis Dispensing Facility operated in strict compliance with State law applicable thereto” to the list of conditional uses in the B5A Downtown Perimeter District;

9. Amend Section 155.420(B) of the Village Code to add “Cannabis Dispensing Facility operated in strict compliance with State law applicable thereto” to the list of permitted uses in the I Limited Industrial District;

10.Amend Section 155.802 of the Village Code (Rules and Definitions) establishing definitions for cannabis dispensing facility, cultivation centers, craft growers, processing organizations, and transporting organizations consistent with the definitions found in the Cannabis Regulation and Tax Act;

11.Delete the definition for Medical Cannabis Dispensing Organization in Section 155.802;

12.Amend the definition for Smoking establishment in Section 155.802 to delete the word “medical” therefore prohibiting all types of cannabis in a Smoking establishment; and

13.Create a new Section 155.225: Cannabis Establishments:

a.Establish buffer requirements for Cannabis Dispensing Facility establishments from a public or private elementary or secondary school, day care center, day care home, group day care home or part day care facility or another lawfully established cannabis dispensing facility.

b.Regulations to specifically exclude cultivation centers, craft growers, processing organizations and transporting organizations as a permitted or a conditional use activity.

c. Regulations to specifically preclude on-site consumption of cannabis as part of any permitted or conditional land use activity. The petition is referred to as PC 19-19.
