California: Shasta County Board of Supervisors: Cannabis Cultivation Regulations

NOTICE OF PUBLIC HEARING AND SUMMARY OF AN ORDINANCE AMENDING THE SHASTA COUNTY ZONING PLAN WITH RESPECT TO CANNABIS CULTIVATION REGULATIONS (ZA-18-0007) SHASTA COUNTY BOARD OF SUPERVISORS NOTICE IS HEREBY GIVEN that the Shasta County Board of Supervisors will consider recommended environmental determinations and hold a public hearing on whether to

(1) find that the proposed ordinance is not subject to and exempt from the requirements of the California Environmental Quality Act;

(2) find that the proposed ordinance is consistent with the County General Plan, and

(3) introduce, waive the reading of, and enact an ordinance amending the Shasta County Zoning Plan, Title 17 of the Shasta County Code, with respect to cannabis cultivation regulations (Zone Amendment ZA18-0007).

The public hearing to consider the proposed ordinance will be held in the Board of Supervisors' Chambers at 1450 Court Street, Room 263, Redding, California, on Tuesday, June 18, 2019 at 9:00 a.m. or as soon thereafter as the business of the Board of Supervisors will allow. SUMMARY OF THE PROPOSED ORDINANCE: The proposed ordinance, consisting of 5 sections would, among other amendments in accordance with state law and as more fully described in the ordinance, establish regulations for the cultivation of cannabis for medical and nonmedical purposes as follows: (1) continue to prohibit outdoor cultivation of cannabis; (2) permit the cultivation of cannabis within a residence or within a residential accessory building associated with a residence subject to regulations as stated in the ordinance; (3) establish regulations for the cultivation of cannabis within a residence and within a residential accessory building associated with a residence; and (4) limit the total number of cannabis plants that may be cultivated within a residence and within a residential accessory building associated with that residence to six.

ENVIRONMENTAL DETERMINATION: The ordinance is not subject to and exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15061(b)(3) (there is no possibility the activity in question may have a significant effect on the environment). In addition to the foregoing general exemptions, the following categorical exemptions apply: sections 15308 (actions taken as authorized by local ordinance to assure protection of the environment), 15321 (action by agency for enforcement of a law, general rule, standard or objective administered or adopted by the agency, including, but not limited to, by direct referral to the County Counsel as appropriate for judicial enforcement), and 15303 (new construction or conversion of small structures, e.g., a residential accessory building). There are no unusual circumstances under CEQA Guidelines section 15300.2(c). Each exemption stands as a separate and independent basis for determining that this ordinance is not subject to CEQA. GENERALPLAN CONSISTENCY: The ordinance is consistent with the County General Plan on the basis that the ordinance discourages excess grading and safeguards against disturbance and development on unstable slopes (General Plan Sections 5.1, 6.1), protects against degradation and misappropriation of water resources (General Plan Sections 5.1, 6.6), reduces exposure of the general public to hazardous materials (General Plan Section 5.6), protects agricultural, timber, recreation and other resource lands for their intended lawful purposes including habitat and production of food and fiber, guards against encroachment of large scale or illegal outdoor cultivation onto these lands (General Plan Sections 6.1 through 6.10), and is in furtherance of the public necessity, health, safety, convenience, and general welfare. ALL INTERESTED PARTIES are encouraged and invited to submit written comments regarding the proposed actions or be present at the public hearing to be heard regarding the actions to be considered including, but not limited to, the finding that CEQA does not apply to the proposed ordinance and that the proposed ordinance is exempt from CEQA. To ensure consideration by the Board of Supervisors, all written material concerning the proposed project should be submitted to the Department of Resource Management, Planning Division, 1855 Placer Street, Suite 103, Redding, California 96001 as soon as possible and no later than three days prior to the hearing.

All items presented to the Board of Supervisors before or during a public hearing, including but not limited to, letters, e-mail, petitions, photos, or maps, become a permanent part of the record. It is advised that the presenter bring ten copies of anything presented to the Board of Supervisors, and that the presenter create copies in advance for their own records.

Persons wishing to submit comments or appear before the Board of Supervisors are encouraged to first contact Planning Manager Kim Hunter. Recommendation for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

 

PRESENT and ADOPT the accompanying ORDINANCE, dated May 28, 2019, amending Section 104.06.1 of Article 4 of Chapter 10 of the LAMC to provide that if an applicant would have been among the 100 Tier 1 and Tier 2 applicants eligible for further processing in Round 1 of Phase 3 of Type 10 retail licensing except that its business premises is located in an area of undue concentration, the applicant shall be eligible for further processing if the City Council ultimately finds that approval of the License application would serve public convenience or necessity pursuant to Section 104.03 of the LAMC.

Colorado: Snowmass Village: Finalize Marijuana Licensing Process

The Local Marijuana Licensing Authority has conducted a detailed and thorough review to finalize the rules, regulations, and forms for the Town to successfully review, process, and license retail marijuana stores in Snowmass Village. Upon the final approval of all licensing documents and forms from the LMLA, staff is asking for the LMLA to formally grant staff the authority to make edits, tweaks, and amendments to the documents – should the need arise. This will allow the Town to make any necessary improvements, in an efficient manner, which do not affect the intent of the review process and will eliminate the need for minor changes to be brought before the authority.

STAFF RECOMMENDATION: That Town Council make and approve a motion to: Allow staff to make any necessary administrative changes to the review process and forms that are deemed to not adversely impact the intent of the overall process and still meet requirements of the enacting ordinance.

Public hearing will consider an amendment to Stockton Municipal Code, Title 5 "Business Licenses and Regulations and Title 16" Development Code, regarding Commercial Cannabis Businesses.

The proposed amendments will affect Stockton Municipal Code Sections 5.98 (Cannabis Business License Tax), 5.99 (Cannabis Business License Tax), 5.100.050 (Application for Cannabis Operator Permit), 5.100.070 (Grounds for denial of Operators Permit), 5.100.120 (Suspension and Revocation of Operators Permit), 5.100.150 (Employee Work Permit Required), 16.64.040 (Number of parking spaces required), and 16.80.195 (Cannabis Businesses-Permitting). The purpose of the amendment is to:
Approve by-right allowances for existing cannabis retail storefront businesses to conduct distribution and non-volatile manufacturing, if located in industrial zones;
Approve by-right allowances for existing cannabis cultivator businesses to include retail storefront (dispensary) activities, if located in industrial zones;
Align location requirements with the State's location requirements;
Update the tax rate system by identifying tax rates by business type; 
Introduce a workforce diversity requirement for all cannabis businesses;
Adjust parking requirements for cannabis cultivators to 1 (one) space per 2,000 square feet; 
Update definitions to include Microbusiness in Title 5.

REPLACEMENT OF LOCAL BUSINESS REPRESENTATIVE ON THE CANNABIS CITIZEN ADVISORY COMMITTEE 

At its meeting of 4/16/19, the City Council nominated four applicants interested in serving on the Commercial Cannabis Citizen Advisory Committee as the Local Business Representative.  The Council appointed Mike Waltz to the Committee.  The Committee currently meets every Wednesday at 3:00 p.m. Mr. Waltz has notified the City Clerk that he is unable to attend the Committee meetings on the scheduled day and time, and has requested that fellow applicant and nominee, Dayna Wyman replace him on the Committee.  Since the Committee is comprised of members appointed by Council, the City Clerk is requesting that the Council replace Mr. Waltz with one of the three other nominees for Local Business Representative. Those nominees are Will Clark, Roger Hart, and Dayna Wyman. (Report - Deborah R. Presson, City Clerk)

WHEREAS, the Borough of Oradell, in the County of Bergen and State of New Jersey (the "Borough") has a comprehensive Master Plan and Development Ordinances implementing that Master Plan; and

WHEREAS, the Borough has determined that businesses selling recreational marijuana require special concern for security, and location; and

WHEREAS, there is no area of the Borough which can safely house a business selling recreational marijuana and/or the paraphernalia that facilitates the use of such marijuana. NOW,

THEREFORE, BE IT ORDAINED, by the Governing Body of the Borough of Oradell, in the County of Bergen and State of New Jersey, as follows:

SECTION I. Chapter 240 of the Borough Code, at Section 6.12 entitled "Uses Prohibited In All Zones", Subsection A, is hereby amended to delete the existing item "10" from the list of uses prohibited in all zones and add a new item "10" as follows: 10. The cultivation, manufacture, warehousing, distribution and sale of Cannabis and/or the paraphernalia that facilitates its recreational use. For the purposes of this section Cannabis shall be defined as all parts of the plant Cannabis sativa Linnaeus, Cannabis Indica or Cannabis ruderalis, whether growing or not; the seeds thereof; the resin, whether crude or purified, extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture or preparation of the plant, its seeds or resin. Cannabis also means the separated resin, whether crude or purified, obtained from cannabis. Cannabis does not include the mature stalks of the plant, fiber produced from the stalks, oil or cake made from the seeds of the plant, any other compound, manufacture, salt, derivative, mixture or preparation of the mature stalks [except the resin extracted therefrom), fiber, oil or cake, or the sterilized seed of the plant which is incapable of germination. For the purpose of this section Cannabis does not mean Industrial Hemp.

SECTION II. All ordinances or parts thereof, which are inconsistent with the provisions of this Ordinance, are hereby repealed to the extent of their inconsistencies.

SECTION III. In the event any section, part or provision of this Ordinance shall be held unconstitutional or invalid by any Court, such holding shall not affect the validity of this Ordinance or any remaining part of this Ordinance other than the part held unconstitutional or invalid. SECTION IV. This Ordinance shall be subject to review and recommendation by the Borough Planning Board in accordance with N.J.S.A. 40:55D-26. SECTION V. The County Planning Board shall be provided notice of this proposed ordinance in accordance with N.J.S.A. 40:27-6.10. SECTION VI. This Ordinance shall take effect immediately upon its final passage and publication as required by law and filing with the Bergen County Planning Board.

California: Farmersville Planning Commission: Cannabis Dispensary

Notice of Availability of Environmental Study And Public Hearings The City of Farmersville has prepared an Initial Environmental Study for the project entitled "General Plan Amendment/Zone change 2019-03 and Conditional Use Permit 2019-06 (Platinum Connection)". This project proposes several planning requests/permits relating to development of a 4.5-acre parcel situated at 685 W. Noble Avenue, on the south side of Noble Avenue, west of Farmersville Boulevard. The Assessor Parcel Number of the site is 128-250-003. Specific planning requests include: 1. An amendment of the zoning designation for the site (from the CS (Service Commercial) zone to the IL (Light Industrial) zone; 2. An amendment of the General Plan land use designation for the site from "Service Commercial" to "Light Industrial" and 3. Phase 1 will include a cannabis dispensary and another commercial building, and Phase Two will include several buildings intended for cannabis cultivation. Formal hearings will be held to receive public input on the newly developed rule 21.20.3 NMAC – Hemp Manufacturing Rule. Purpose: To develop a rule to accompany statutory language which allows the department of agriculture to administer the hemp manufacturing program. The 2018 farm bill removed hemp from the federal controlled substances act and provided a framework for the growing of hemp. NMDA is currently licensing hemp producers.

The department has worked closely with producers and processors who are seeking security in the development of the extracting, processing, and manufacturing components of this new industry. During the 2019 legislative session HB 581 Hemp Manufacturing Act was passed and signed into law. The legislation grants the New Mexico Department of Agriculture and the New Mexico Environment Department the regulatory authority over manufacturers, processors, labs, researchers, and plant breeders.

Rule Summary: To establish a rule for the administration of the hemp manufacturing act components of the Hemp Manufacturing Act assigned to the New Mexico Department of Agriculture. The proposed rule establishes licensure requirements for laboratories, breeders, researchers, fee caps, and inspection/sampling requirements.

Legal Authority Authorizing the Rule: Granted to the board of regents of New Mexico State University under the Industrial Hemp Manufacturing Act, Chapter 76, Article 24, Section 1, NMSA 1978 Compilation. Michigan: Marijuana Regulatory Agency

May 29, 2019 – The Marijuana Regulatory Agency (MRA) announced today that it will hold its first public meeting on Thursday, June 13, 2019 at the Williams Building, 525 West Ottawa Street, Lansing, Michigan in the First Floor Auditorium at 9:30 A.M.

The MRA is required to hold at least four public meetings each calendar year for the purpose of hearing complaints and receiving the views of the public regarding the administration of the authorities, powers, duties, functions, and responsibilities vested in the Agency.

The MRA intends to livestream the meeting on the Dept. of Licensing and Regulatory Affairs’ Facebook page for those who are unable to attend in person.

The purpose of this public hearing is to receive public comment on the MRA’s administration of the following statutes:

  • Michigan Medical Marihuana Act (2008)

  • Michigan Medical Marihuana Facilities Licensing Act (2016)

  • Marihuana Tracking Act (2016)

CITY OF VINELAND LEGAL NOTICE PLEASE TAKE NOTICE that upon the Application of the Columbia Care New Jersey, LLC ("Applicant"), the City of Vineland Planning Board will conduct a public hearing on Wednesday, June 12, 2019, commencing at 7:30 P.M. Applicant is requesting that the Planning Board grant Bulk Variance Approval to allow for (i) side yard buffers of five (5) +/- feet and seven (7) +/- feet where Ordinance Section 425-382 requires a minimum buffer width of twenty-five (25) feet. Applicant also requests that the Planning Board grant Design Waivers to allow for (i) a two-way driveway with a sixteen (16) foot width where twenty-four (24) feet are required; (ii) a zero (0) foot driveway opening setback from an extended property line where a five (5) foot setback is required; (iii) an end island width of eight (8) feet where ten (10) feet is required; and (iv) a thirteen (13) space parking row length without a tree island break where a maximum twelve (12) space parking row is permitted. This Ordinance will update and modify current land use regulations and zoning development standards applicable to commercial cannabis activity facilities, including cultivation, manufacturing, testing, and distribution, and cannabis retailer businesses in order to: better reflect State statutes and regulations, expand allowable locations within the City to conditionally permit cannabis retailer businesses, increase the maximum number of allowable retail cannabis businesses in various commercial and industrial zoning districts throughout the City; modify current development standards for new commercial cannabis activity facilities in the industrial sectors, and make conforming amendments thereto. 


The Ordinance has been assessed in accordance with the California Environmental Quality Act (CEQA), the State and local CEQA Guidelines, and the environmental regulations of the City. The proposed Ordinance qualifies as being exempt from CEQA pursuant to Section 15060(c)(2) of the CEQA Guidelines (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and Section 15060(c)(3) of the CEQA Guidelines (the activity is not a "project" as defined in Section 15378 of the CEQA Guidelines because it has no potential for resulting in physical change to the environment, directly or indirectly).


Copies of the Ordinance are available for public inspection at the Coachella Development Services Department between the hours of 7:00 am and 6:00 pm, Monday through Thursday. City Hall is closed on Fridays. (Se Habla Español)
