Adoption of an Ordinance Amending Title 5 of the Pittsburg Municipal Code Related to Cannabis Regulations

On September 16, 2019, the City Council considered and voted 3-2 to introduce and waive first reading of a text amendment to Pittsburg Municipal Code (PMC) Title 5, Chapter 5.70, sections 5.70.051 and 5.70.160 in order to: 1) specify how required distances between cannabis businesses and potentially sensitive uses are measured; 2) clarify definitions of specific potentially sensitive uses; and 3) establish a minimum distance of 1,000 feet between cannabis dispensaries and potentially sensitive uses, in the event cannabis dispensaries are allowed in the future. The Ordinance is being brought back before the City Council for adoption.

A bill for an ordinance amending the alcohol beverages and retail marijuana chapter of the Denver Revised Municipal Code to repeal language that is duplicative of state law and to allow adult patrons of the national western center to consume malt, vinous, or spirituous liquors within approved areas of the national western center. Amends Chapter 6 of the Denver Revised Municipal Code (DRMC) to allow adult patrons of the National Western Center to consume malt, vinous, or spirituous liquors in approved areas within the National Western Center in Council District 9 in accordance with recent changes to state law. Learn about Federal and State laws regulating Cannabis and the City's proposed legislation.

The City of National City is seeking input from community members to guide the development of regulations for commercial cannabis businesses.  The City Council has directed staff to develop a draft ordinance that could permit and regulate up to 3 commercial cannabis businesses within the City, which could include a combination of retailers, cultivation, manufacturing, distribution, microbusinesses and testing facilities.  These businesses would only be allowed in the City’s designated Industrial Zones.  Cannabis retailers would only be allowed as an accessory use (secondary use) in conjunction with cultivation, manufacturing or distribution.

Each business would be required to enter into a development agreement through which the business would agree to pay a Community Benefit Fee that would provide revenue to the City to address specified community needs.  These benefits are yet to be defined and will be negotiated with each business as a part of their development agreement.

The City is seeking input from the community to help guide this process.  Specifically, the City is seeking input on the following issues which would be addressed through regulations, development agreements and community benefit fees:

          •     Community impacts to be addressed through regulations

          •     Programs to be funded through community benefit fees

The proposed Resolution No. 19-59 clarifies and interprets local cannabis regulations in light of State regulations. Because local regulations work in conjunction with and incorporate State regulations, the drive-through window regulations are necessarily included in local regulations. The proposed Resolution No. 19-59 was drafted at the direction of the City to provide clarification regarding the City’s interpretation of its local regulations in light of State regulations.

SECTION 1: "Definitions" shall be amended to add a new uses, reading as follows: "Act" shall mean the New Jersey Compassionate Use Medical Marijuana Act, P.L. 2009, c. 307 (approved January 18, 2010, codified at N.J.S.A. 24:6I-1 et seq. "Department" means the Department of Health and Senior Services. "Marijuana" shall mean all parts of the plant Genus Cannabis L., whether growing or not; the seeds thereof; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant or its seeds, except those containing resin extracted from the plant; but shall not include the mature stalks of the plant, fiber produced from the stalks, oil or cake made from the seeds of the plant, any other compound, manufacture, salt, derivative, mixture, or preparation of such mature stalks, fiber, oil, or cake, or the sterilized seed of the plant which is incapable of germination as defined by "New Jersey Controlled Dangerous Substances Act," P.L.1970, c.226 (C.24:21-2). "Medical use of marijuana" means the acquisition, possession, transport, or use of marijuana or paraphernalia by a registered qualifying patient as authorized by "New Jersey Controlled Dangerous Substances Act," P.L.1970, c.226 (C.24:21-2). "Medical marijuana alternative treatment center" or "alternative treatment center" shall mean an organization approved by the department to perform activities necessary to provide registered qualifying patients with usable marijuana and related paraphernalia in accordance with the provisions of the "New Jersey Compassionate Use Medical Marijuana Act" P.L.2009, 3 c.307 (C.24:6I-1 et seq.). This term shall include the organization's officers, directors, board members, and employees. Medical marijuana cultivation facility shall mean a commercial entity licensed under New Jersey Compassionate Use Medical Marijuana Act N.J.S.A.24:6I-1 et seq. that cultivates, dries, trims, or cures marijuana for sale to marijuana product manufacturing facilities, and to other marijuana cultivation facilities, but not to consumers. This entity shall hold all required state licenses and permits. Medical marijuana manufacturing facility: A commercial facility licensed under a commercial entity licensed under New Jersey Compassionate Use Medical Marijuana Act N.J.S.A.24:6I-1 et seq. that receives marijuana from a licensed cultivation facility and extracts resin from the marijuana or creates a marijuana- infused product for sale and transfer in packaged form to a medical marijuana center. This entity shall hold all required state licenses and permits. Medical marijuana safety compliance facility: A commercial facility licensed under New Jersey Compassionate Use Medical Marijuana Act N.J.S.A.24:6I- 1 et seq. that receives marijuana from a licensed cultivation facility, licensed processing facility, or licensed caregiver, tests it for contaminants and for tetrahydrocannabinol and other cannabinoids, returns the test results, and may return the marijuana to the marijuana facility. Medical marijuana center shall mean an entity permitted by a State agency to sell marijuana and marijuana products registered qualifying patients directly, or through the patients' registered primary caregivers pursuant to the "New Jersey Compassionate Use Medical Marijuana Act" P.L.2009, 3 c.307 (C.24:6I-1 et seq.).

SECTION 2. In accordance with Section 22-4 DISTRICT REGULATIONS, 22-4.5 is amended to include 22-4.5b as follows: Medical Marijuana Uses 1. Location Condition: a. All facilities must be designed and operated to minimize the amount of pesticides, fertilizers, nutrients, marijuana, and other potential contaminants discharged into the public wastewater and/or stormwater systems. b. A list of all pesticides, fertilizers, and any other hazardous materials that are expected to be used in the cultivation process. c. All facilities must be designed to minimize odors emanating from the marijuana plants. d. All facilities must submit Odor Management Plan. e. All facilities must maintain a secure, closed, clean environment in the room where marijuana is to be stored, grown, processed, or tested, in order to prevent outside contamination and prevent the inadvertent and/or unauthorized removal of marijuana from the facility. All facilities must provide shower and locker room facilities for employees to ensure the provision of a clean environment. f. All facilities must have adequate security to prevent access to the marijuana by non-authorized personnel, including unauthorized removal. All rooms that contain marijuana, in any form, must be individually locked and accessible only to authorized personal. g. All drying, soil mixing, testing, processing, and other non-growing activities must take place in a separate room from any growing activities. 2. Designated Area: a. No Medical Marijuana Center, Medical Marijuana Alternative Treatment Center (ATC), Medical marijuana Safety Compliance Center, Medical Marijuana Manufacturing Facility or Medical Marijuana Cultivation Facility shall be located within the following distances from the specified land uses listed below: i. One thousand (1000) feet from place of worship, schools, playgrounds, parks, recreational facility, residence, mobile home parks. ii. One Thousand (1,000) feet from any premises serving alcohol.

SECTION 3: Enforcement: the Provisions of this section shall be enforced by the Construction Official.

SECTION 4: All Ordinances or parts inconsistent herewith are hereby repealed as to such inconsistency only. Each and every other provision of the sections and schedules not modified by this Ordinance shall remain in full force and effect. SECTION 5: This Ordinance shall take effect upon the passage, publications and the erection of signs as required by law.

The Iowa Office of Medical Cannabidiol provides the following update on petitions to add or remove debilitating medical conditions that will be deliberated at the Medical Cannabidiol Board’s next meeting on November 1, 2019. Public comments will be received during a public meeting of the subcommittee, starting at 8:30 a.m. on Friday, November 1, 2019. 

The meeting will be held at the Iowa lab facility on the DMACC campus in Ankeny, Iowa. Forty-five minutes will be set aside for public comment at the subcommittee meeting. Members of the public wishing to address the subcommittee will be asked to keep their comments to 3 minutes or fewer. D. Consumption of cannabis shall not be permitted on the premises of any cannabis business establishment or medical cannabis establishment.

The subject property is known as Block 7 Lot 25 on the official tax records of the Township of Lafayette. The Applicant proposes to construct a new approximately 338,000 SF building to house a medical marijuana growing and processing facility and approximately 22,000 SF greenhouse. The proposed project would also demolish certain buildings on the site. One existing building with an area of approximately 30,000 SF will be renovated to house administrative space and research and development laboratories. There will be no sales or retail component on this site as part of this application. The Applicant seeks a Use Variance, if it is determined by the Board that one is necessary, as it is unclear whether this use falls within the permitted uses in the Light Industrial Zone. The Applicant also seeks certain bulk variances including: a height variance to permit the new building to be 38.5 feet high where 35 feet is permitted; a parking variance to allow parking within the front yard setback, as well as a variance for the number of spaces where 929 are required based on the square footage of the buildings, but 322 are proposed based on the number of employees and passive use of most of the building square footage. The Applicant may also apply for such variance relief, exceptions, waivers, permits, approvals or licenses that are deemed necessary or appropriate by the Applicant or the Board, and which may arise during the course of the hearing process. This application is now on the calendar for the Lafayette Township Land Use Board and a public hearing has been set for Thursday, October 17, 2019 at the Lafayette Township Municipal Building, 33 Morris Farm Road, Lafayette, New Jersey at 7:30 P.M. When this case is called you may either appear in person or by an attorney for the purpose of being heard with respect to this application. The matter will be heard on the above date or any adjourned date designated by the Land Use Board at the public meeting without additional notice. 10.A Approval of the Qualified Registration List of Cannabis Retail Businesses as Recommended by the Interim Community Development Director In 2018, the City of Benicia issued a Request for Proposals (RFP) for cannabis retail and microbusiness operators. In response to the RFP, the City received nine cannabis retail proposals and no microbusiness proposals. Subsequently, a 5-member proposal review panel scored and ranked the applications based on criteria adopted by the City Council and issued Public Safety License approval letters to seven applicants. The seven retail applicants comprise the Qualified Registration List. The purpose of the Planning Commission meeting is to review the Qualified Registration List and either approve or deny the Qualified Registration List.

RECOMMENDATION:

Recommendation:

1)  Staff Report;

2)  Entertain questions of Staff from City Council;

3)  Open the Public Hearing;

4)  Take testimony from those in favor;

5)  Take testimony from those opposed;

6)  Take testimony from those in a neutral position;

7)  Close the Public Hearing;

8)  City Council discussion and questions to Staff; and

The recommended text amendments to the LaSalle County Zoning Ordinance will address the following:

ADULT-USE CANNABIS LaSalle County Zoning Ordinance Sections to be amended: Section 3.1 Definitions, Section 4 General Provisions, Section 7.1-4 Special Uses (A1), Section 7.2-4 Special Uses (AC), Section 9.1-4 Special Uses (B1), Section 9.2-4 Special Uses (B2), Section 10.1-4 Special Uses (I1) The proposed text amendments, in their entirety, are on file for review at the LaSalle County Environmental Services and Land Use Department located at 119 West Madison Street, Room 107, Ottawa, Illinois (Phone 815-434-8666), or at the LaSalle County Clerk's office located at 707 East Etna Road, Ottawa, Illinois.
